Privacy policy

This data protection declaration informs you about the type, scope and purpose of the processing of personal data (hereinafter referred to as "data") within our online offer and the websites, functions and content connected with it as well as external online presences, such as our social media profiles (hereinafter jointly referred to as "online offer"). With regard to the terms used, such as "processing" or "controller", we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).

Types of data processed:

  • Personal data (e.g., names, addresses).
  • Contact data (e.g., e-mail, telephone numbers).
  • Content data (e.g., text input, photographs, videos).
  • Usage data (e.g., web pages visited, interest in content, access times).
  • Meta/communication data (e.g., device information, IP addresses).

Categories of data subjects

Visitors and users of the Online Offer (Hereafter, we also refer to the data subjects collectively as "Users").

  • Responding to contact requests and communication with users.

  • Reach measurement/marketing

Terms used

"Personal data" means any information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. a cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

"Processing" means any operation carried out for the purpose of identifying a natural person, whether by reference to an identifier or not.

"Processing" means any operation or set of operations which is performed upon personal data, whether or not by automatic means. The term is broad and covers virtually any handling of data.

"Profiling" means any automated processing of personal data which consists in using such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects relating to that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or change of location.

"Controller" means the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data.

"processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Relevant legal basis

In accordance with Art. 13 DSGVO, we inform you about the legal basis of our data processing. If the legal basis is not mentioned in the privacy statement, the following applies: The legal basis for obtaining consent is Art. 6(1)(a) and Art. 7 DSGVO, the legal basis for processing in order to fulfil our services and carry out contractual measures and respond to enquiries is Art. 6(1)(b) DSGVO, the legal basis for processing in order to fulfil our legal obligations is Art. 6(1)(c) DSGVO, and the legal basis for processing in order to protect our legitimate interests is Art. 6(1)(f) DSGVO. In the event that vital interests of the data subject or another natural person make processing of personal data necessary, Art. 6 (1) (d) DSGVO serves as the legal basis.

Security measures

We shall take appropriate technical and organisational measures to ensure a level of security appropriate to the risk, taking into account the state of the art, the cost of implementation, the nature, scope, context and purposes of the processing, as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, in accordance with Article 32 of the GDPR.

Security measures shall include, but are not limited to, measures to protect the rights and freedoms of natural persons.

Measures include, in particular, ensuring the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access to, entry into, disclosure of, assurance of availability of and segregation of the data. We also have procedures in place to ensure the exercise of data subjects' rights, deletion of data and response to data compromise. Furthermore, we already take the protection of personal data into account in the development and selection of hardware, software and procedures, in accordance with the principle of data protection through technology design and through data protection-friendly default settings (Art. 25 DSGVO).

Collaboration with processors and third parties

If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transmit it to them or otherwise grant them access to the data, this is only done on the basis of a legal permission (e.g. if a transfer of the data to third parties, such as to payment service providers, is necessary for the performance of the contract pursuant to Art. 6 (1) lit. b DSGVO), you have consented, a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).

If we commission third parties with the processing of data on the basis of a so-called "order processing agreement", this is done on the basis of Art. 28 DSGVO.

Transfers to third countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or do so in the context of using third-party services or disclosing, or transferring, data to third parties, this will only be done if it is done in order to fulfil our (pre-)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we only process or allow the processing of data in a third country if the special requirements of Art. 44 ff. DSGVO are met. This means, for example, that the processing is carried out on the basis of special guarantees, such as the officially recognised determination of a level of data protection corresponding to that of the EU (e.g. for the USA through the "Privacy Shield") or compliance with officially recognised special contractual obligations (so-called "standard contractual clauses").

Rights of data subjects

You have the right to request confirmation as to whether data in question are being processed and to information about these data, as well as further information and a copy of the data in accordance with Art. 15 GDPR.

You have according to. Article 16 of the GDPR, you have the right to request that the data concerning you be completed or that inaccurate data concerning you be corrected.

You have the right, in accordance with Article 17 of the GDPR, to request that the data in question be deleted without delay or, alternatively, to request restriction of the processing of the data in accordance with Article 18 of the GDPR.

You have the right to obtain the data concerning you that you have provided to us in accordance with Art. 20 of the GDPR and to request their transfer to other data controllers.

You also have the right to lodge a complaint with the competent supervisory authority in accordance with Art. 77 DSGVO.

Right of withdrawal

You have the right to revoke consents granted in accordance with Art. 7 (3) DSGVO with effect for the future

Right of objection

You may object to the future processing of data relating to you in accordance with Art. 21 DSGVO at any time. The objection can be made in particular against processing for direct marketing purposes.

Cookies and the right to object to direct marketing

Cookies are small files that are stored on users' computers. Different information can be stored within the cookies. The primary purpose of a cookie is to store information about a user (or the device on which the cookie is stored) during or after his or her visit to an online service. Temporary cookies, or "session cookies" or "transient cookies", are cookies that are deleted after a user leaves an online offer and closes his or her browser. In such a cookie, for example, the contents of a shopping basket in an online shop or a login status can be stored. Cookies that remain stored even after the browser is closed are referred to as "permanent" or "persistent". For example, the login status can be stored if users visit them after several days. Likewise, the interests of users can be stored in such a cookie, which is used for range measurement or marketing purposes. Third-party cookies" are cookies that are offered by providers other than the responsible party that operates the online offer (otherwise, if they are only its cookies, they are referred to as "first-party cookies").

We may use temporary and permanent cookies and provide information on this in our data protection declaration.

Deletion of data

The data processed by us will be deleted or restricted in its processing in accordance with Articles 17 and 18 DSGVO. Unless expressly stated within the scope of this data protection declaration, the data stored by us will be deleted as soon as they are no longer required for their intended purpose and the deletion does not conflict with any statutory retention obligations. If the data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted. I.e. the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for reasons of commercial or tax law.

According to legal requirements in Germany, data is stored for 10 years in accordance with §§ 147 para. 1 AO, 257 para. 1 nos. 1 and 4, para. 4 HGB (books, records, management reports, accounting vouchers, commercial books, documents relevant for taxation, etc.) and 6 years in accordance with § 257 para. 1 nos. 2 and 3, para. 4 HGB (commercial letters).

According to legal requirements in Austria, retention is in particular for 7 years pursuant to § 132 para. 1 BAO (accounting records, vouchers/invoices, accounts, receipts, business papers, statement of income and expenditure, etc.), for 22 years in connection with real property and for 10 years for records in connection with electronically provided services, telecommunications, radio and television services provided to non-entrepreneurs in EU member states and for which the Mini-One-Stop-Shop (MOSS) is claimed.

Amazon Affiliate Programme

We are participants in the affiliate programme on the basis of our legitimate interests (i.e. interest in the economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO), we are participants in the Amazon EU affiliate programme, which is designed to provide a means for websites to earn advertising fees by placing advertisements and links to Amazon.de (so-called affiliate system). I.e. as an Amazon partner, we earn from qualified purchases.

Amazon uses cookies to track the origin of orders. Among other things, Amazon can recognise that you have clicked the affiliate link on this website and subsequently purchased a product from Amazon.

We are participants in the partner programme on the basis of our legitimate interests (i.e. interest in the economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO), we are participants in the affiliate programme of Booking.com, which was designed to provide a medium for websites by means of which advertising fees can be earned through the placement of advertisements and links to Booking.com (so-called affiliate system). Booking.com uses cookies to track the origin of bookings. Among other things, Booking.com can recognise that you have clicked on the affiliate link on this website and subsequently made a booking with Booking.com.

Google Analytics

On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. DSGVO) Google Analytics, a web analytics service provided by Google LLC ("Google"). Google uses cookies. The information generated by the cookie about the use of the online offer by the users is usually transmitted to a Google server in the USA and stored there.

Google is certified under the Privacy Shield Agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate the use of our online offer by users, to compile reports on the activities within this online offer and to provide us with further services related to the use of this online offer and the internet. In doing so, pseudonymous user profiles can be created from the processed data.

We only use Google Analytics with IP anonymisation activated. This means that the IP address of the user is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

The IP address transmitted by the user's browser is not merged with other Google data. Users can prevent the storage of cookies by setting their browser software accordingly; users can also prevent the collection of the data generated by the cookie and related to their use of the online offer to Google as well as the processing of this data by Google by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de

The users' personal data is deleted or anonymised after 14 months.

We use the AdSense service, with the help of which advertisements are displayed on our website and we receive payment for their display or other use. For these purposes, usage data such as the click on an ad and the IP address of the user are processed, whereby the IP address is shortened by the last two digits. Therefore, the processing of the users' data is pseudonymised.

We use Adsense with personalised ads. In doing so, Google draws conclusions about users' interests based on the websites they visit or apps they use and the user profiles thus created. Advertisers use this information to tailor their campaigns to these interests, which is beneficial for users and advertisers alike. For Google, ads are personalised if collected or known data determine or influence the ad selection. This includes, but is not limited to, previous searches, activity, website visits, app usage, demographic and location information. Specifically, this includes: demographic targeting, targeting on interest categories, remarketing, and targeting on customer match lists and audience lists uploaded to DoubleClick Bid Manager or Campaign Manager.

The Google website is not a part of the Google website.

In dieser Datei wird vermerkt, welche Webseiten der Nutzer aufgesucht, für welche Inhalte er sich interessiert und welche Angebote der Nutzer geklickt hat, ferner technische Informationen zum Browser und Betriebssystem, verweisende Webseiten, Besuchszeit sowie weitere Angaben zur Nutzung des Onlineangebotes.

Ferner erhalten wir ein individuelles „Conversion-Cookie“. Die mit Hilfe des Cookies eingeholten Informationen dienen Google dazu, Conversion-Statistiken für uns zu erstellen. Wir erfahren jedoch nur die anonyme Gesamtanzahl der Nutzer, die auf unsere Anzeige geklickt haben und zu einer mit einem Conversion-Tracking-Tag versehenen Seite weitergeleitet wurden. Wir erhalten jedoch keine Informationen, mit denen sich Nutzer persönlich identifizieren lassen.

Die Daten der Nutzer werden im Rahmen des Google-Werbe-Netzwerks pseudonym verarbeitet. D.h. Google speichert und verarbeitet z.B. nicht den Namen oder E-Mailadresse der Nutzer, sondern verarbeitet die relevanten Daten cookie-bezogen innerhalb pseudonymer Nutzerprofile. D.h. aus der Sicht von Google werden die Anzeigen nicht für eine konkret identifizierte Person verwaltet und angezeigt, sondern für den Cookie-Inhaber, unabhängig davon wer dieser Cookie-Inhaber ist. Dies gilt nicht, wenn ein Nutzer Google ausdrücklich erlaubt hat, die Daten ohne diese Pseudonymisierung zu verarbeiten. Die über die Nutzer gesammelten Informationen werden an Google übermittelt und auf Googles Servern in den USA gespeichert.
